Register NowSpencer Lucas will be presenting on PSR's landmark $135,000,000 verdict in the case of Blair & McGregor v. Moreno Valley Unified School District. This was a child sexual abuse case in which both Plaintiffs Justin McGregor and Brady Blair were severely abused by their sixth-grade teacher from 1996 and 2001. The verdict found the school district 90% at fault with a zero percent finding of fault on the boys' parents. This presentation will break down the litigation from discovery all the way through trial focusing on the strategies which made the case successful which can be applied to nearly all childhood sexual abuse cases.
Like many child sexual abuse cases this case had many hurdles the trial team had to overcome including the fact that all of the sexual abuse happened off campus. Making matters more difficult was the fact that the school district blamed the parents of each Plaintiff because they knew about the teacher's prior allegations of child sexual abuse and allowed their children to be around the perpetrator unsupervised.
Discovery in matters which occurred decades ago is always a challenge. In this case the District stonewalled discovery and hid key documents which were ultimately exposed during expert discovery. The webinar will discuss useful methods of obtaining key discovery necessary to establish notice evidence. Successful deposition techniques of adverse institutional witnesses will be highlighted.
A detailed analysis of the trial preparation will be explored including selection of the best retained experts, cross-examination of the defense experts, focus groups, mock jury selection, and preparing the plaintiffs for an arduous trial.
The trial will be broken down discussing strategy of jury selection, opening statements, presentation of evidence, and final argument strategy.
