From May 2022 to May 2023, Plaintiff, Ross Byer, worked as a Police Officer for the City of La Palma.From May 2022 through November 2022, Ross successfully completed his new officer training, and received a score of “meets expectations” in every performance category on his six-month performance evaluation.

In December 2022, Ross (a White officer) was reassigned to a Korean sergeant - Sergeant Won Koh.Prior to the reassignment, another White officer warned Ross to “watch out” for Sergeant Koh.Just weeks after being reassigned, Koh began targeting Ross by assigning him additional work – something Sergeant Koh was not doing to Ross’s Korean partner, Officer Choi.

In January 2023, Ross reported Sergeant Koh’s conduct to Captain Jesse Amend.After making multiple complaints to Captain Amend, Koh began writing Ross up for various “performance issues” and on May 31, 2023 Sergeant Koh gave Ross his 12-month evaluation, which rated Ross as “needs improvement” and denying him a pay raise.Ross resigned the following day, June 1, 2023.
