$8.26M Verdict: Trusting the Truth to Prove Actual Knowledge on Circumstantial Evidence

In November 2025, a Denver jury returned an $8,260,000.00 verdict for our client under the Colorado Premises Liability Act (PLA). Our client, riding his e-scooter outside his apartment, struck a mangled section of sidewalk and suffered catastrophic injuries, including a moderate traumatic brain injury, spinal fractures, and a torn biceps tendon. The sidewalk had been improperly restored following utility work by a Verizon subsidiary (MCI) and its general contractor, KGPCo. Despite a permit requiring concrete replacement, the sidewalk remained dangerously fragmented for over 18 months until our client's crash.

Settlement efforts went nowhere. Initial mediation failed. Even on the eve of trial, the highest offer was $3.5M—well below the scope of our client’s life care plan. Our client rejected it and trusted the jury.
