The three defendants were Roeder Holdings, LLC, and two individuals Amiee and Ryan. Only the LLC had assets. Roeder is a property holding company owned by John Roeder with a variety of properties in Idaho and Texas. It owns, among other things, dilapidated 12000 sq foot house on 4.5 acres in Meridian Idaho. The “Roeder mansion.” Roeder Holdings did not have insurance on the property.
Before Roeder purchased it, the mansion had become a party destination. It was graffiti covered inside and out with broken windows. After purchasing it Roeder didn’t want it to deteriorate more. Roeder’s buddy would check on the mansion and do some handyman work to protect the property, but the partying continued.
The buddy suggested they get someone to live in the house to fend off trespassers and vandals. He got a friend named Amiee who paid no rent or utilities to live there. When she moved in she had a dog. She admitted the dog was in part to help protect against the trespassers. Her boyfriend moved in with her, they had a baby and her dog had puppies.
Our client was invited to the property and had her service dog with her. While on the property, she was attacked by the dogs. The central issues were whether Aimee was an agent of Roeder thereby making it liable and whether our client had intervened in a fight between her service dog and the dogs on premises.
