City of San Diego, et al., PSBR attorneys Tom Schultz, John Shaller and James Trotter obtained a $20 million settlement for a 52-year-old bicyclist and his wife after the man suffered C2-C3 quadriplegia when he rode his bicycle into an open construction trench with cones placed in front in a cordoned off construction zone. In Jane Doe v. Roe Corporation, et al., the firm obtained a $20 million settlement for a 26-year-old bicyclist who sustained a permanent traumatic brain injury when she was struck from behind by a food delivery driver while riding her bicycle late at night on a highway. After the collision, the bicycle was found in a ditch with no lights illuminated on the bicycle and the bicyclist was found without a helmet on and with methamphetamine in her urine on admission to the hospital. In both cases, the defense attempted to shift the blame entirely onto the injured plaintiffs, alleging that their catastrophic injuries were a result of their own negligence. Tom Schultz, John Shaller, and James Trotter will explain how they were able to overcome these claims and successfully negotiate these two $20 million settlements.
