Getting to Amazon, FedEx, and Other Large Entities that Hide Behind the Independent Contractor Defense: The largest U.S. shippers are moving most of the freight being delivered every day by hiring third-party motor carriers to do so. However, many of the motor carriers are in exclusive contracts with or running exclusively for the Amazons and FedEx’s of the world. In addition, they are controlling the timing, manner, and method of how the trucking company and even the truck driver move the freight. Joe will explore the various legal theories and proof necessary to get to the larger entities that put the dangerous truck driver and trucking company on the road that caused the crash.
