One purpose of voir dire is to ferret out limiting ideas, attitudes, biases and beliefs that can keep potential jurors from doing their job fairly. But we know that is not always enough. There are deeper assumptions driving juror decision making above and beyond biases they can discuss with you. This is especially true for the large cohort of jurors – about 50% in most venires – who share a set of assumptions which can derail your story in their heads if you don’t align your delivery with them.
Even supposedly “universal” concepts like justice may diverge for this group of jurors from what the lawyer assumes is true. Imagine how dangerous it would be for an attorney to argue what s/he sees as “fair”, “right” or “just” when certain jurors don’t see it that way at all – and can’t easily put the way they do see it into words.
In this presentation Eric will introduce you to the 10 Unspoken Assumptions about half of your jurors are likely bringing into your courtroom. And he will show you tools to craft case presentations that align with these widely held assumptions.
